The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis caused by the presentation of a new 28-article proposal for resolving the conflict appeared โ€“ momentarily โ€“ to have been contained. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: an extensive attack of aerial bombardment on Kyiv.

The Pattern of Diplomacy and Destruction

The sequence of conflicting incidents captured the harsh reality of the recent timeframe. By day, political struggles are fought: positive announcements are delivered from different nations. Significant resources is expended on restraining specific proposals. By night, Russian leadership forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "settlement".

Nighttime Reality

As the offensive unfolded into the early hours of Tuesday, the present situation of Ukraine's vulnerability was exposed. Ukraine is able to track rocket firings from Russian territory, a capacity afforded by timely intelligence. From vantage locations, military aircraft that had been deployed to intercept incoming aerial threats roared overhead โ€“ modern combat jets provided to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons thundered: multiple launches fired to intercept a Russian ballistic missile. This was a modern interception technology at work, presumably supplied through partner states. Every deployment creates sudden vibrations, causing tremors. The brief panic quickly transforms into resigned acknowledgment: possibly the approaching threat won't cause damage this time, preventing destruction from catastrophe and further power outages.

Ongoing Risks

Soon after, a automatic firearm opened up on a drone in the vicinity, part of a defensive team โ€“ almost certainly imported technology. Regrettably, the projectiles didn't strike the hostile drone โ€“ it pressed on overhead toward its destination.

Periodically, this carried on until dawn. Kyiv faced the early updates: multiple fatalities, destruction and utility failures in many homes as a result of the night's assault. As customarily, everyone still continued their routines โ€“ experiencing conflict. But those 24 hours illustrated Ukraine's essential dependence on Western support โ€“ a reliance that neighboring countries are clearly incapable to fill in the short term.

Ineffective Peace Efforts

The comprehensive proposal from American leadership sparked intense emotion, controversy and profound anxiety โ€“ and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and international summits.

Every new proposal from American administration unfolds according to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually secure success. This trend will, no doubt, endure.

Strategic Calculations

It is easy to blame specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the whole story. American leadership operates on a premise understood by experienced diplomats: you cannot achieve through diplomacy what you have failed to defend militarily. The American government presumes that it is impossible to force Russia to relinquish the areas that it currently occupies in Ukraine's occupied territories.

The challenge is that while accepting these circumstances, Washington does minimal to deter Moscow, through statements or actions, from thinking that the status quo will not change more in its favour in the near future.

Opposing Positions

Therefore, Moscow is convinced that the clock favors them โ€“ that Ukraine and its partners are approaching exhaustion. Their reason to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be numerous efforts to achieve ceasefire, but they will carry on as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, gradually sacrificing people and territory but avoiding a entire defensive failure until conditions improve in its favour.

Existing Situation

Factually, there are no actual prerequisites for a truce. Now, personal considerations are becoming relevant: personal goals to mediate resolution and secure international recognition, and Ukrainian leadership's twin challenges โ€“ on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any plan Kyiv finds unsuitable, so that their focus does not move to homefront challenges. And although their objective will now be much harder after recent developments, it remains highly unlikely that this will alter their fundamental strategy.

These opposing factors are guiding negotiations.

Summary and Prospects

It took a just a single week to kill the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by Washington, resistance by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, recent disclosures, all did their job.

While new plans based on established approaches are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to fend off political attacks from Washington that are based on Russian demands and demonstrate particular unwillingness to change the course of events, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, largely rely on sustained allied backing.
